NO
PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES
OF WINNING.
Please
read these rules before entering the MYHABIT.COM Fall Fashion Sweepstakes (the
“Sweepstakes”). You agree that, by
submitting an entry, you will be bound by these Official Rules and you
acknowledge that you satisfy all sweepstakes eligibility requirements.
Eligibility. If you are an
individual legal resident of the 50 United States or the District of Columbia
and are the older of 18 years of age or the legal age of majority in your state
of residence at the time of entry, you are eligible to enter the
Sweepstakes. Our employees and employees
of Daily Front Row, Inc. ("Daily Front Row”), Offerpop Corporation (“Offerpop”),
and Daily Front Row’s, Offerpop’s and our employees’ immediate family members
(spouses, domestic partners, parents, grandparents, siblings, children and
grandchildren), and Daily Front Row’s, Offerpop’s and our affiliates, advisors
or advertising/promotion agencies (and their immediate family members) are not
eligible to enter the Sweepstakes.
How to Enter. You may enter the Sweepstakes beginning at 12:00:01 a.m. (ET) on September 12, 2012 and ending at 11:59:59 p.m. (ET) on October 5, 2012 (the “Sweepstakes Period”). To enter, you must enter via either Entry Method #1 or Entry Method #2 below.
Entry
Method #1
(1) Go to http://bit.ly/OV9xUE;
(2)
Click the “Follow on Twitter” button and proceed to follow the MYHABIT Twitter
page “@MYHABIT”; and
(3)
Click the “Tweet” button and proceed to Tweet the following message: “I just
entered the @MYHABIT @DailyFrontRow #FallFashionSweeps. NO PURCH NEC. Details: http://bit.ly/OV9xUE.”
You must have a Twitter account and be logged in to your account to enter via Entry Method #1. You may not use multiple Twitter accounts to enter the Sweepstakes, and an entrant who submits entries through multiple accounts will be disqualified.
Entry Method #2
(1) Go to www.facebook.com/MyHabit and click
on the “Fall Fashion Sweepstakes” tab;
(2) Click the “Like” button to “Like” the page www.facebook.com/MyHabit if you have not already done so; and
(3) Complete
the online entry form.
You must have a Facebook account and be logged in to your account to enter via Entry Method #2.
Limit one entry per person and e-mail address per Entry Method #1
and Entry Method #2.
Mailing List. By
entering the Sweepstakes, you consent to being placed on a mailing list for
promotional and other materials for MYHABIT.COM. You may update or change your “My e-mail settings”
in your MYHABIT.COM account at www.myhabit.com/emailpreference.
Other
Promotions.
Please note that we may be running similar sweepstakes at the same time
as this Sweepstakes. By entering this
Sweepstakes, you will not be eligible to receive any prize awarded in any other
sweepstakes unless you enter each sweepstakes separately.
Prize.
We will award one Grand Prize consisting
of:
- Tickets for the winner and his/her
guest to attend select NY Fashion Week shows in New York in February,
2013;
- Three nights standard hotel
accommodations for the winner and his/her guest (single room, double
occupancy) at a New York City area hotel (the “Hotel”) in February, 2013; and
- A $500.00 MYHABIT gift card (“GC”)
for the winner.
The total approximate retail value of the
Grand Prize is $3,500.00. Actual Grand
Prize value may vary based on factors at time of booking, including but not
limited to hotel price fluctuations. Grand Prize does not include transportation, travel or spending money;
all extras are at winner's own expense. Winner is responsible for securing any
additional travel arrangements necessary to receive the NY Fashion Week tickets and Hotel portion of the Grand Prize. If the actual value of any prize is less than the stated
ARV, we will not award the difference in cash.
All portions of the Grand Prize are subject to availability and change
and are at our sole discretion.
The
winner must have or will need to create an Amazon.com or MYHABIT account in
order to redeem the GC. The GC may only
be used for purchases of eligible goods on Amazon.com or certain of its
affiliated websites. Redemption of the
GC will be subject to our standard terms, conditions and restrictions
applicable to Amazon.com Gift Cards in effect on the day of issuance of the
GC. The GC cannot be redeemed for the
purchase of gift cards. Except as
required by law, the GC cannot be reloaded, resold, transferred for value,
redeemed for cash, or applied to any other account. Amazon is not responsible if any GC is lost,
stolen, destroyed or used without permission.
If the GC is lost or stolen, it will not be replaced. See www.amazon.com/gc-legal for
complete terms and conditions. The GC is
issued and © 2012 by ACI Gift Cards, Inc., a Washington corporation.
The
winner will be: (a) responsible for paying all costs and expenses related to
the prize that are not specifically mentioned herein, including, but not
limited to, taxes, transportation, food and beverages, gratuities, incidentals,
baggage costs, telephone calls, excursions, and any other expenses that might
reasonably be incurred by winner in receiving or using the prize; and (b)
required to submit his/her social security number or tax payer ID number to us in
order to claim the prize.
Prize
Drawing.
The potential winner will be selected at a random drawing to be held on
or about October 15, 2012. We must
receive eligible entries during the Sweepstakes Period for them to be eligible
for the drawing. Within 5 business days
following the drawing, we will notify the potential winner by phone or e-mail, or
by direct message to the potential winner’s Twitter account and he/she will be required
to sign an Affidavit of Eligibility and Liability/Publicity Release. Potential Grand Prize winner’s guest, who also
must be the older of 18 years of age or the legal age of majority in his or her
state of residence, also will be required to sign and return a Liability/Publicity
Release prior to participation in the prize.
We may select an alternative potential winner if any potential winner
does not return the requested, completed document(s) by the date requested by
Sponsor, or meet the eligibility criteria.
The prize will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND,
express or implied (including, without limitation, any implied warranty of
merchantability or fitness for a particular purpose).
Odds
of Winning.
Odds of winning depend on the number of eligible entries received.
Additional
Terms.
We may, to the maximum extent permitted by applicable law and in our
sole discretion, change these rules or cancel the Sweepstakes at any time; or
modify, terminate, or suspend the Sweepstakes should viruses, worms, bugs,
unauthorized human intervention or other causes beyond our control corrupt or
impair the administration, security, fairness or proper play of the Sweepstakes
or submission of entries. We are not
responsible for: (a) lost, misdirected,
late, incomplete, or unintelligible entries or for inaccurate entry
information, whether caused by you or by any of the equipment or programming
associated with or utilized in the Sweepstakes, or by any technical or human
error that may occur in the processing of entries; (b) any printing or typographical
errors in any materials associated with the Sweepstakes; (c) any error in the
operation or transmission, theft, destruction, unauthorized access to, or
alteration of, entries, or for technical, network, telephone, computer,
hardware or software, malfunctions of any kind, or inaccurate transmission of,
or failure to receive any entry information on account of technical problems or
traffic congestion on the Internet or at any website; or (d) injury or damage
to your or any other computer resulting from downloading any materials in
connection with the Sweepstakes. We may,
in our sole discretion, disqualify any individual found to be: (x) tampering
with the entry process or the operation of the Sweepstakes or website; (y)
acting in violation of these rules; or (z) acting in an unsportsmanlike or
disruptive manner or with intent to annoy, abuse, threaten or harass any other
person. If your entry is incomplete or
if you use robotic, automatic, programmed or similar entry methods, your entry
will be void. The authorized subscriber
of the e-mail account associated with the Twitter account or Facebook account
used to enter the Sweepstakes at the actual time of entry will be deemed to be
the participant and must comply with these rules in the event of a dispute as
to entries submitted by multiple users having the same e-mail account. The authorized account subscriber is the
natural person who is assigned an e-mail address by an Internet access
provider, on-line service provider, or other organization responsible for
assigning e-mail addresses for the domains associated with the submitted e-mail
addresses. No greater than the number of
prizes stated in these Official Rules will be awarded. If any technical errors occur in the
selection of potential prize winner or if more prizes are claimed than the
number of prizes being awarded as provided in these Official Rules, we may
award the prize by random drawing from among all eligible claimants.
Miscellaneous. The Sweepstakes is
governed by the laws of the United States.
The Sweepstakes and all accompanying materials are © 2012 by Amazon
Services LLC, and its affiliates. All
rights reserved. If you win a prize, you
may not transfer, assign, or redeem the prize for cash. We may substitute a prize with a prize of
equal or greater value. The winner
agrees (for himself or herself and his or her heirs) that, by accepting a
prize, we, Daily Front Row and Offerpop, along with each of our respective affiliates
and agents, any
entity involved in any aspect of the Sweepstakes (including funding or
administration), and Facebook and
Twitter (all aforementioned parties are collectively, the “Released Parties”), will
have no liability, and will be held harmless by the winner for any liability,
loss, injury or damage to property or person, including death, and reasonable
attorney’s fees and court costs, due in whole or in part, directly or
indirectly, by reason of the acceptance, possession, use or misuse of the prize
or participation in the Sweepstakes, even if caused or contributed to by the negligence
of any of the Released Parties. You
agree that our decisions related to the Sweepstakes and all drawings are
final. The winner agrees that, by
participating in the Sweepstakes, we may use the winner’s name, image or
likeness in any manner and in any medium for our promotional purposes without
additional compensation, except where prohibited by law.
Winner’s List. After we confirm the winner, we will post the
winner’s name at www.myhabit.com/help/201018090 until April 5, 2013.
